High Court to rule tomorrow
Tamil Nadu: The Chennai High Court is set to deliver the main verdict in the case filed by Vedanta against the Tamil Nadu government's order to close the Sterlite plant tomorrow.
It was decided in 1993 to set up this Cherlite man in the Ratnagiri district of Maharashtra. Due to the high level of opposition thereafter, the Tamil Nadu government gave permission to set up the plant in Thoothukudi next year.
Chennai High Court
The Chennai High Court in 1998 ordered the National Environmental Engineering Research Institute (NIRC) to inspect the Sterlite plant, following a lawsuit filed in 1996 by the National Foundation for the Environment, alleging that the health of the people in the area had deteriorated.
The Chennai High Court had in November of the same year ordered the closure of the plant in view of the contamination of groundwater and air in the study. The Supreme Court then granted permission to direct the man.
Violations of the rule
Then in September 2010, the Chennai High Court again ordered the closure of the plant citing violations of the law. Over the next three days, the Supreme Court quashed the order.
The manhole was closed again in March 2013 due to a poison gas leak. In April 2013, the Supreme Court ordered the Sterlite plant to pay Rs 100 crore in compensation to the victims of the pollution in Thoothukudi.
Air and water
Next on May 22, 2018, 13 people were killed in a shooting that took place during a protest by people against the Sterlite plant. Subsequently, on May 28, 2018, the Tamil Nadu Pollution Control Board and the Government of Tamil Nadu ordered the closure of the Sterlite plant due to air and water pollution.
Sterlite filed a lawsuit against the Tamil Nadu government's order. The National Green Tribunal, which heard the case, set up a panel headed by a retired judge to investigate and issue a report.
National Green Tribunal
According to Agarwal's statement that the Sterlite plant would not cause any harm to the people, the Green Tribunal issued an order to reopen the plant. Following a case in the Supreme Court of the State of Tamil Nadu against the order of the National Green Tribunal. Similarly, Sterlite management filed a petition seeking permission to open the plant.
Re-plant
The Tamil Nadu government has filed a case in the Supreme Court challenging the order of the National Green Tribunal. The Sterlite management also petitioned for permission to open the plant. The apex court had barred the reopening of the Sterlite plant and directed Vedanta to approach the Chennai High Court, saying the National Green Tribunal had no jurisdiction to hear the case.
In June 2019, the Chennai High Court set up a special panel comprising Justices Sivagyanam and Bhavani Subramanian to hear the cases. Since then, the trial has been going on for about 39 days, beginning on June 27, 2019, in this special session.
